Motion Could See All Three Princess Shooting Suspects Tried Together

Christian County Commonwealth’s Attorney Stephanie Bolen plans to file a motion to try all three defendants together in connection to a 2021 shooting outside the Princess Theater that killed one person and injured another.

Deovion Day is charged with murder, first-degree assault, and being a convicted felon in possession of a firearm.

The first matter to be cleared up in Monday morning’s session before Judge Andrew Self was lab reports and other discovery that has not made its way from the Commonwealth to Day’s defense attorney Daniel Whitley, who said he wants to see everything before filing a bond reduction motion for his client.

click to download audioBolen, who was appointed commonwealth’s attorney earlier this year by Governor Andy Beshear, inherited the case from Rick Boling, who resigned in February in the wake of impending Kentucky Supreme Court action regarding his law license.

She said she has been in contact with the state police lab but isn’t sure what reports are still pending to be returned to her office.

click to download audioBolen also informed the court of her intention to file a motion to try Day with two others charged in connection with the case.

Zamarious Humphries and Jaquavian Spencer have been charged with complicity to murder for an altercation that Bolen said led to Day producing a gun and killing Aniyah Collins and injuring G’Teria Acree.

Bolen said it was this action that caused Day to fire a gun at Spencer, instead striking Collins inside a car.

Humphries and Spencer are both represented by Sands Chewning, who reminded the court that Humphries’ trial is scheduled to begin on September 11 with Spencer’s set for October 5.

Day’s next hearing is set for September 7 at which time Judge Self can agree with Bolen’s motion to try all three defendants together, or deny the motion and set a separate trial date for Day, most likely in early 2024.
