Trial Date Set Again in McHenry Street Murder Case

After several delays that have lasted over two years, another trial date has been set for a Hopkinsville man charged with murder now that a special prosecutor has been appointed.

Dennis Foust, commonwealth's attorney for Marshall and Calloway counties, has been appointed the special prosecutor in the case involving Robert Torian III, who is charged with the fatal shooting of Terrell Moore after the two men got into an argument inside a vehicle on McHenry Street in August of 2019.

The appointment was necessary after Christian County Commonwealth's Attorney Stephanie Bolen notified the court there was a conflict of interest in her office regarding this case.

While Foust made his first appearance in Christian County Circuit Court for this case Wednesday afternoon, he told Judge Andrew Self that he would be ready for trial on September 25.

Torian has seen his trial date delayed more than a half-dozen times over the past two years for a variety of reasons — the most recent was Bolen's appointment as Christian County's top prosecutor earlier this year.

Torian's attorney, Jason Byrd, has previously told the court that four years in jail with no reduction in bond was excessive and again asked Judge Self for a modification of the $500,000 bond.
