Discovery Transfer Requested In Peach Street Murder Case

Defense attorneys for Anthony Gaines are still waiting for cell phone data evidence to help them prepare for their defense of the Hopkinsville man charged with two counts of murder.

Attorney Brandi Jones presented a multi-layered motion to Christian County Circuit Judge Andrew Self Wednesday afternoon. She said she had received what she thought was an incomplete report from Cellebrite, a contract agent used by police to extract digital data from cell phones.

click to download audioChristian County Detective Lt. Scott Smith said Cellebrite provided a full extraction from phones belonging to victims George Gomez and Kiera Wallace. However, he said the data file from Gaines’ phone was selected information they received.

Jones also requested information on the number of anonymous tips received in the case.

Judge Self ruled in favor of most of the defense requests to turn over evidence.

click to download audioJones was also concerned about the ability to share evidence and other discovery with Gaines at the jail in preparation for his trial. A computer was formerly made available but Boling said inmate abuse in accessing the internet caused that process to be halted.

Judge Self suggested a re-examining of the process once Jailer-elect Adam Smith assumes office next month.

click to download audioGaines is charged with the August 7, 2021 deaths of Gomez and Wallace, who were found inside a Peach Street home.

In addition to the murder charges, Gaines is charged with first-degree robbery, first-degree burglary, possession of a handgun by a convicted felon, and four counts of first-degree wanton endangerment.

Gaines remains lodged in the county jail under a $1 million bond.
