A Christian Circuit Court judge has set a hearing for next week to set a trial date after a special prosecutor for the commonwealth filed a motion to withdraw the motion to dismiss the perjury charge against retired Hopkinsville Police Lieutenant Jefferson Alexander.

Alexander was indicted in March 2019 for first-degree perjury for allegedly providing false testimony to a Christian County grand jury in 2012 in the case of former city councilwoman Ann Cherry. She was charged with official misconduct, tampering with a witness, and tampering with a public record. As part of a plea agreement, Cherry resigned from her council seat.

In 2017, the City of Hopkinsville settled a federal lawsuit filed by Cherry and agreed to pay her $150,000 but did not admit any wrongdoing as part of the settlement.

In January, special prosecutor Carrie Ovey-Wiggins filed a motion to dismiss the perjury charge against Alexander, which was met with objections from Cherry who cited Marsy’s Law.

James Leskousky was appointed by the Kentucky Attorney General’s Office as special prosecutor to replace Ovey-Wiggins. He then filed a motion to withdraw the motion to dismiss.

Circuit Judge John Atkins signed an order Monday morning granting that motion and set a hearing at 8:30 on March 24 to schedule a trial date.
