Princeton Woman Charged in Fatal Stabbing Appears in Court

A Princeton woman accused in the stabbing death of her estranged husband appeared for a pretrial conference in Caldwell County Circuit Court Tuesday afternoon.

Kimberly Smothers was indicted for murder in the death of 43-year old Matt Smothers in January.

Smothers and her attorney, Andrea Moore appeared virtually before Circuit Judge Woody Woodall. Moore advised the judge she filed a response to a motion filed by the Commonwealth’s Attorney to exclude the victim’s toxicology report. In her response, she said excluding the victim’s toxicology report may hurt her client’s case.

click to download audioCommonwealth’s Attorney Carrie Ovey-Wiggins argued that the victim tested positive for a quantified amount of amphetamines and methamphetamine in his blood but she believes that is not relevant to this case.

click to download audioMoore again advised Judge Woodall she does believe the toxicology report is relevant.

Judge Woodall asked Ovey-Wiggins for a copy of the toxicology and autopsy reports for him to review before he ruled on the motion.

Moore also told the judge they are trying to resolve the case and will let him know if a plea agreement is reached.

Judge Woodall set a new trial date for 9:00 the morning of September 20th with a pretrial conference scheduled for 2:30 the afternoon of February 2nd.

Kimberly Smothers was arrested on January 8 after Princeton police responded to a report of a stabbing in the alley behind 114 Ratliff Street that morning just before 6:00. When officers arrived, they reported found Matt Smothers in the backyard of the residence with a stab wound to his left leg. A witness told police that Matt Smothers’ estranged wife had come to the residence the couple got into an argument, which escalated when she pulled a knife and allegedly stabbed him before fleeing the scene.

The victim was transported by ambulance to the emergency room at Caldwell Medical Center where he later died from his injury.

Kimberly Smothers remains lodged in the Marshall County Jail.
