Hopkinsville men Deovion Day, Zamarious Humphries and Jaquavian Spencer appeared together before Judge Andrew Self Wednesday afternoon in Christian County Circuit Court — with a January 8-9, 2024, trial date suddenly in question.
All charged with various offenses surrounding the 2021 Princess Theater murder of Aniyah Collins, and the injury of G’Teria Acree, new Commonwealth’s Attorney Maureen Leamy said she didn’t know how realistic that timetable was — considering her recent election, the holidays, and the trio’s amended charges since she first entered them nearly two years ago.
Sands Chewning, defense attorney for Humphries and Spencer, also noted that some discovery yet remains in the case.
Chewning also noted that both he, and Leamy, have, however, already received two packets of discovery around the clients.
Day is currently charged with murder, first-degree assault and possession of a hand gun by a convicted felon. Spencer and Humphries are charged with first-degree assault, possession of a hand gun by a convicted felon, complicity to murder and first-degree complicity to assault.
Day’s attorney, Daniel Whitley, sent request for remaining pre-trial conferences be called on Mondays. Self acquiesced, and scheduled everyone’s next appearance for 1 PM December 4.
By then, Self said, everyone would know if a January trial would be feasible.
Bond motions have already been denied for all three men, and prior to the election, former Commonwealth’s Attorney Stephanie Bolen described the crime scene as a “crossfire” that caught Collins and Acree in the middle, and that all parties are implicated in a Snapchat video taken during the night of the incident.
