McHenry Street Murder Trial Delayed For Sixth Time in 2022

The trial date of a Hopkinsville man charged with murder has been continued yet again as attorneys work to get all forensic evidence reports received and the court system works to fit a new trial date into a busy calendar.

Robert Torian III was scheduled to stand trial on Monday. He is charged with the 2019 fatal shooting of Terrell Moore after the two men got into an argument inside a vehicle on McHenry Street.

In the latest request for a continuance, defense attorney Jason Byrd said they have been waiting on a forensic report from a download of content on a locked cell phone. Commonwealth’s Attorney Rick Boling confirmed to Circuit Judge Andrew Self a new computer program used by forensic detectives has been successful in unlocking the phone and downloading its content for use by investigators.

click to download audioJudge Self agreed to continue the case to March 13 of next year due to the inability of the attorneys to agree on open dates before then. It marks the sixth time that Torian’s trial date has been continued for various reasons in the past nine months. Torian has expressed his displeasure at the repeated continuations and asked to speak with his defense attorneys about a course of action.

Boling also told the court that an assault charge against Torian stemming from an incident while in the Christian County Jail is expected to be presented to the Christian County grand jury Friday.
