A Hopkinsville man, who was released from prison after his sentence was commuted by former Governor Matt Bevin in his final days in office last month, was indicted by the Oldham County Grand Jury Friday morning.
An Oldham County Circuit Court clerk tells the News Edge Dayton Jones was indicted for first-degree promoting contraband and second-degree persistent felony offender.
Oldham County Commonwealth’sAttorney Courtney Baxter tells us Jones was caught with suboxone in September at Luther Luckett Correctional Complex. She says the lab results to confirm the drug, which is used to treat opiate addiction, did not come back until December 30.
According to Baxter, if Jones is convicted on the new charges he could face a maximum sentence of ten years in prison.
Former Governor Bevin signed an executive order on December 9 commuting Jones’s sentence. He was serving 15-years in prison after he admitted to his role in a brutal sexual assault of a 15-year old male at a party at a residence on Lafayette Road in 2014.
At this time, Jones has not been arrested in connection to the indictment in Oldham County.
The News Edge also learned Friday that one of Jones’s co-defendants Tyler Perry was indicted by the Muhlenberg County Grand Jury. Muhlenberg County Commonwealth’s Attorney Ralph Vick tells us Perry was indicted on January 3rd for first-degree promoting contraband and second-degree persistent felony offender. He says Perry and other inmates were found in possession of suboxone on February 18. Perry was serving his 10-year sentence at the Green River Correctional Complex in Central City after he took a plea deal and pled guilty to first-degree assault in 2016 for his role in this case.
