The rape and sodomy case against a former Oak Grove Police officer could be dismissed after a motion is filed and set to be heard next week in Christian Circuit Court.

Ben Walden is facing numerous charges, including 1st Degree Sodomy, 1st Degree Rape, and 4th Degree Assault. He is accused of paying a female victim $200 for sex before telling her he was a police officer, putting his gun on the nightstand, putting a pillow over her face, and raping and sodomizing her.

According to court records, special prosecutor Ralph Vick, of the Commonwealth’s Attorney Office, made a motion to have the case dismissed without prejudice. Judge Andrew Self asked that the Commonwealth file a motion to dismiss the case for review. He then set a hearing for the motion to be heard on Friday afternoon, May 11th at 1:00.

Attorney Rick Boling is representing Walden in the case.
